Expect to be banned. Make the splash screen. That way, he'll have to choose between a buggy version and a working version that insults GaySexCentral.

I believe they broke rule number 2 by deleting the thread without posting a reason. It is highly disrespectful to delete a thread just to shut someone up. They are too chicKen s@%^$ to have someone question them so they delete the thread rather than discuss the issue.

Rule 7 was broke by rune plenty of times.

That's nothing surprising. When ever Rune gets completely owned, he just makes a nonsensical reply. It's a defense mechanism.

Eew! Rune changed the name of the program? I like the idea of a splash screen, maybe something like:
http://www.freewebs.com/dimondedge/kwsplash.jpg
Yes, that is a crappy photoshop made in five minutes. VC++ wouldn't show me the GUI output for no reason other than it's windows, so I had to fudge it.
Of course, you'd have to copywrite Kode Garage to do that, but that is not too hard.

Rune is such an asshole.

I suggest you check the text here http://www.cybercrime.gov/ipmanual/01ipma.html Specifically this part:
the law wrote:
# I.B.1. Copyright

The law of copyright is designed to foster the production of creative works and the free flow of ideas by providing legal protection for creative expression. Copyright provides protection against the infringement of certain exclusive rights in "original works of authorship fixed in any tangible medium of expression," including computer software; literary, musical, and dramatic works; motion pictures and sound recordings; and pictorial, sculptural, and architectural works. See 17 U.S.C. § 102(a). These exclusive rights include the rights of reproduction, public distribution, public performance, public display, and preparation of derivative works. 17 U.S.C. § 106. Legal protection exists as soon as the work is expressed in tangible form. Copyright law protects the physical expression of an idea, but not the idea itself.

Although civil law protects all the copyright owner's exclusive rights, criminal law primarily focuses on the rights of distribution and reproduction. See 17 U.S.C. § 506(a) and 18 U.S.C. § 2319. Those convicted of criminal copyright infringement face up to five years' imprisonment and a $250,000 fine. Id.

let me put this in simple terms for you Rune:
1) Legal protection exists for my software as soon as I release it
2) I alone hold the right to who may or may not distribute this regardless of whether or not I choose to inform you within the license file.
3) If charged, you face up to 5 years and $250,000 fine
4) You have been given a polite request to remove my software from this site, I hope you will reconsider.
5) I have the money and the time to follow through with this.

Title: All in a day's work.
Thanks to United States Copyright Law, any and all works released by a group or individual in the US are automatically granted copyright protection. (Unless expressly denied by the author, for example, by placing the works into the public domain.) "Filing for copyright" to the US Copyright office is almost never done by individuals or small non-profit organizations. That would typically be reserved for larger corporations, and especially more often with patenting than copyrighting.

Are you saying that when I released my software here that it voids out the automatic copyright? If so I believe that is wrong.

http://www.gnu.org/philosophy/categories.html#PublicDomainSoftware
states:
gnu wrote:
Under the Berne Convention, which most countries have signed, anything written down is automatically copyrighted. This includes programs. Therefore, if you want a program you have written to be in the public domain, you must take some legal steps to disclaim the copyright on it; otherwise, the program is copyrighted.

http://www.law.cornell.edu/treaties/berne/18.html
BERNE CONVENTION wrote:
Article 18

(1) This Convention shall apply to all works which, at the moment of its coming into force, have not yet fallen into the public domain in the country of origin through the expiry of the term of protection.

(2) If, however, through the expiry of the term of protection which was previously granted, a work has fallen into the public domain of the country where protection is claimed, that work shall not be protected anew. ....

Expiry of the term of protection occurs when I die plus 50 years after for the minimum protection required.

No, I said that in order to become public domain it must explicitly be released as such (as in, expressly denying the copyright). Since that is obviously not the case here, I couldn't even be mistaken to imply such nonsense, right?

well, i was a little fuzzy on what releasing into the public domain meant. NOT your fault at all. I see what you meant. But, at least I have proof also now :D that I am protected because I did NOT explicitly release it into public domain. Have any recommendations for lawyers dealing with specifically this issue? this could shut down GSC if Rune does not comply with my request and I follow through with this.

My suggestion would be calling some local attorneys and speaking with them about the issue. If nothing else, they will certainly have some people to direct you to who might be better suited for the job. Just keep in mind that it's going to be an international lawsuit; Rune (James Woolley) is in Canada, and the server is hosted in Germany by LLCoolDave (David Spickermann), a German citizen.

No it isn't. Contacting the host about the copyright infringement is a fine option.

The Link is still there for download even after he updated the site's main page.
If it's not removed by tomorrow, I'd make another thread.

Yeah, GSC banning someone because they violated his intellectual property is just like them. It's not going to change the fact that they've violated copyright law, nor is it going to cover it up. How hilariously vain!

I guess they don't get a heads-up for legal action, then. I'd advise anyone associated with the site to become unassociated.
